Join us as we look through the facts of the Elsipogtog First Nation’s land and the 1824 Illegal Taking Claim. Find out why we need the entire Elsipogtog community’s input.

THE DATA

Timeline & Process

Reviewing documentation from as early as the year 1700 until present day 2021, a legal team discovers that land belonging to Elsipogtog First Nations has changed from 51,200 acres to just 4600 acres.

History of the Claim

Here we look at The Treaty Era, The Royal Proclamation, Indians and settlers, trespassers, and the original reserve for the “Richibucto Tribe of Indians”

Location

Next we compare 2 maps of the reserve: the original from 1809 showing 51,200 acres, and a modern map showing a mere 4,600 acres. 

Negotiation Process

A legal team begins researching historical documents and draft a claim submission. Negotiations begin between Elsipogtog and a team of negotiators from Canada.

Next Steps

As negotiation protocol is in place, the land must now be appraised and value given to the claim. The agreement in principle must be approved by community referendum.

Each and every Band member has a right to benefits from the settlement as a part of the collective.

Only the community can agree to the terms of a settlement. The lands illegally taken in 1824 were reserve lands set apart for the whole community, in common. A settlement of the claim is therefore also for the community, in common. Each and every Band member has a right to benefits from the settlement as a part of the collective.
